Vital Records

WHO MAY OBTAIN VITAL RECORDS?

West Virginia is not an “open records” state. Birth, death, marriage, and fetal records are not full access public records, Access is restricted. In general, if you do not have a “direct and tangible interest” in the record, you cannot obtain a copy.

For Birth and Death Records, the registrant (the person named on the certificate immediate family and their legal representatives) are automatically considered to be direct interest) For Marriage Records, the bride, groom, any of their adult children (grandchildren and their legal representatives) are considered to have a direct interest.

Immediate family means you must be a spouse, parent, child (great) grandparent, grandchild, brother or sister. Aunts, uncles, nephews, nieces, or cousins are not considered immediate family. We make an exception for the record of events that took place before a certain date. These older records will be copied for genealogical purposes for anyone.

When Do Vital Records Become Available for Genealogy?

Type of Records Years Available
Births Before 1925
Deaths Before 1975
Marriages Before 1975

Any records after these dates are restricted and are not available for open genealogical research.

Must have a photo ID when trying to pick up your document. Birth and Death document orders by mail can only be paid with cash or a money order. Documents picked up in office can be paid with cash or check.
